Reporting stolen content and taking legal action - Copyright Infringements

This section is relevant if a file from you has been shared on Flightsim.to without permission. It can happen that you come across addons that look very familiar or similar to other addons. If you suspect that an addon has been copied from another addon and you are the original owner of the original addon, you can follow these steps:

• Make sure that you are the legitimate copyright holder of the original file. You must have created an unique work of intellectual creation that can clearly be assigned as your creation, which has been copied by someone else in a substantial way.
  
  
• Collect any and all evidence that this file has been (partially) copied from your addon.
  
  
• Collect any information about the infringing file, this includes: link to the infringing file, a description of the stolen content and any comparison images (preferably with highlighted similarities).
  
  
• Collect all information about your file, this includes: the link to your original file and any comparison images (preferably with highlighted similarities).
  
  
• Collect this information in an e-mail.
  
  
• Add the following statement to the e-mail: "Under penalty of perjury, I confirm that I am the copyright or intellectual property owner or I am authorized to act on behalf of the copyright or intellectual property owner and that the information provided in the notice is accurate."
  
  
• Please let us know if you want the file to be irrevocabily deleted from our platform, or if you want the file to remain online, but with proper credits to you and your original file.
  
  
• Add your first and last name to the e-mail.
  
  
• Send the e-mail to [email protected] or [email protected]

With this information, we'll try to help you out to the best of our abilities. Keep in mind that the report has to come from the original creator of the original file. Moreover, just stating that a file has copied yours isn't sufficient, you should be able to provide proof of the infringement. The more details and the more accurate, the faster we will be able to process your report.

Important Notice - Not everything can be protected by copyright. If you have not created an unique work of intellectual creation, you cannot claim copyright on the file. That means, especially for liveries, you cannot claim that someone else uses your base files, if they do not constitte an intellectual creation. You can also not claim copyright on textures or assets that belong to someone else - for example on logos or design concept of airlines - which you are only allowed to use based on the Fair Use doctrine. Note: If you are not the original creator of the original addon, you cannot file a copyright report on someone else's behalf, you should inform the original creator that their addon has been copied and let them file the report, we cannot handle requests that come from third-parties.
